For as long as Michael Moore has been making documentaries, he has been criticized for manipulating footage and distorting facts. Now his filmmaking practices are biting him in the ass, as he's being sued for one such misrepresentation in his 2004 Cannes-winner Fahrenheit 9/11. Sgt Peter Damon is an Iraq War veteran who appeared in the documentary by way of an interview he did with NBC's Nightly News. He was never asked for consent (it wasn't legally necessary). Because his character was inaccurately used and his beliefs wrongly represented as being anti-war, Damon is suing Moore and Miramax Film Corp. for $75 million. His wife is also suing for another $10 million because of the emotional distress caused by her husband's emotional distress. Good for them. Usually I think lawsuits like these are a bit over the top, and the amounts asked for are a little too high, but I am happy to see Moore called out on his shifty use of editing to illustrate his points. I'd like to sue him for badly representing liberals, myself. And, while I'm at it, for badly representing non-fiction filmmaking, too. Unfortunately I'm not really emotionally distressed by his work -- a little embarrassed, but not enough that any judge would grant me any damages.

Thank you! I rarely see Michael Moore get called out by a non-conservative. His film making skills leave much to be desired as well as his ability to move past emotionally charged points and into logical debate.

I'm glad to see someone expose this self-aggrandizing shmuck for what he is. I'm more or less a centrist but I can't stand this pompous ass or his "documentries".

Michael Moore give the right some of its own medicine, so what if he manipulated the evidence a little. So what if to make a point, he took comments out of context. I personally think he's brilliantly demonstrated the counter side of the Bush Administration's tactics. This administration has constantly lied, misled and needlessly killed hundreds of Americans in their bogus quest for security. How many people have died because of Michael Moore's point of view?

I just watched the segment of F11 that is under litigation, and it is absolutely clear that Damon will lose his lawsuit, as he should. The jury will see the same thing I saw---Damon wasn't even the focal point of the segment, much less the only soldier interviewed. His words weren't twisted in any way, and he makes no statements about the war pro or con. He's clearly nothing but an opportunist. He was maimed in the war, in the service of the military which he voluntarily joined, and now he wants a paycheck. The Bush administration is the one who should compensate him for what it did to him, not Moore. F911 was brilliant film-making, propaganda or no. How anyone can take the idiotic FahrenHype seriously is beyond me: using Ann Coulter as a source for anything automatically discredits it. Simply watch F911 without paying any attention to Moore's narrative, and the truth is still undeniable. Bush is deceitful, slow-witted lunatic. Hate mail welcome. I'll use it for my book.

I also am not a fan of Moore's deceptive editing style, mostly because I tend to agree with his politics and I think the way he edits screws up the message. However, if he can be sued for misrepresenting what someone said in a documentary, then everyone on, say, Fox News could be sued for the same thing. Ever listen to Sean Hannity's radio show? Hannity himself bills at as "news and information." Yet he constantly misrepresents people's images by twisting their words around. And do the airtime math in that comparison. Moore makes a film every few years that people have to pay to see in a theater or rent on DVD. Hannity has three hours EVERY DAY on free national radio, plus an hour on national television. Moore and Hannity are two sides of the same coin, so Sean could be sued every time he opens his mouth with this precedent.
Moore's films are not cinema verite. It's propaganda and everyone knows this. Just as Fox News is propaganda. Matt Stone didn't like the way Moore cut to a South Park style cartoon after a clip of Stone in Bowling for Columbine because he felt Moore was trying to give the impression that Matt and Trey made the cartoon for the Columbine movie. They did not. So did Stone sue Moore? No, he and Trey blew up a puppet of Michael Moore in Team America as their revenge.

You are totally right, Josh. Fox News is just as guilty. And I'm not exactly saying that lawsuits are in order. Damon is going a bit far with his asking price, if you ask me, but I think it is fair for him to get his side of the story out there.
Anyway, Moore has been doing this long before Fahrenheit 9/11 and even long before Fox News. I enjoy his films and I think he's quite amusing, but considering much of the population is too gullible to see around him or Fox, I continue having a problem with their practices.

Why has it taken Captain Hook two years to decide to sue Michael Moore? Sounds like he has been put up to this by someone wanting to damage Michael Moore.

Maybe after two years he couldn't take his embarrassment and emotional distress any longer? Maybe somebody is helping him in their desire to damage Moore's reputation, but what is the difference? Anyway, Miramax and NBC are also being sued.

To me, I would just consider the movie, "Fahrenheit 9/11" as a "Fiction" movie even though he intended to show it as a non-fiction movie.
He has misused the "Right of Freedom of Speech" and should be reprimanded and exiled from all United States of America soil!
He may "win the battle" but with prayer, he won't "win the war" of this lawsuit!

Michael Moore is a great American. He has the guts to say it like it is. Everything he said (and was lambasted for)when he got his oscar turned out to be true. Not many had the guts to be against the war at that time. Michael did. Maybe if more people had his guts and spoke out earlyer we wouldn't be in the shap we are in today.

Are you serious? - I guess you don't keep up with the news! He [Michael Moore] doesn't know the "truth" - He doesn't tell the "whole" truth, just parts he likes!
He is "unAmerican".

Michael Moore likes to portray himself as liberal man of the people, defender of the down-trodden, yet he maintains a very expensive and elitist style home for himself and makes a great deal of money from his films. His films are obviously sharply edited to depict his agenda and deliberatly inflammatory, which might be nice if he were indeed motivated by facts and desire to help others. He is not, hes actaully one of the very capitalist fat cats he bashes.

Toni, have you "served our country, fought for our freedom"? Doing that doesn't make you a "real" American. It does show that you wanted to serve the country, but if you don't do that, you'll still be an American. An American can be anyone. I'm supposed to believe that the news is telling the truth? Just as some of you say that Michael Moore is editing things to show his P.O.V., so is the News. Somehow I refuse to believe that Moore's films "rank right up there with the pro-nazi propaganda filth that hitler put out durring WW2."
Have you not noticed that EVERYONE dogs Americans. Even other Americans.
