'Watchmen' Trial Moved Back to January 20

Don't panic! You can start to sweat a little if you want to, I'm sure everyone associated with Watchmen might be. According to Variety, the Watchmen trial has been moved back two weeks to January 20th. The judge in charge of the case set the new date on Monday in order to settle a criminal matter on January 6th. He has also refused to make a pre-trial summary judgment, as requested by both sides, insisting that the original contracts between Fox and producer Larry Gordon are so open to interpretation that a trial is required.
They just keep upping the drama level of this whole mess. Why is the judge insisting on taking it to trial, ignoring the wishes of both sides to do a summary judgment? Is that a good thing? Are summary judgments too hasty or something? Is he stretching this out because he can? Can they still settle out of court? If there's a legal eagle in the Cinematical house, I'd love it if you weighed in, just for the sake of discussion and clarity. (Without a first hand look at the contracts, maybe that's impossible to do.)
While I still don't believe the film will be delayed, it is worrying to see its legal troubles inching closer and closer to its March 6th date. Neither side seems willing to blink, although Warner Bros might if it threatens all the money they've put into marketing. But think about it this way, readers -- if they do delay it, anything Watchmen that you own that's marked 03/06/09 immediately becomes more valuable!

Summary judgement is only for when there is no dispute as to the facts of the case, and one party is entitled to judgement as a matter of law. There is no way that the judge, based on what I've read about the case, can decide definitively for one side or the other. Therefore, there has to be a trial.

I have to say, Rodney, I was more then a little hesitant to click your link, given how many people will pimp their random, totally off-topic blogs on comment sections such as this one... However, curiosity got the best of me and I did click it and upon doing so I was pleasantly surprised to find you are a man of your word and have put together a very interesting, informative and comprehensive guide to this whole Watchmen legal mess.
If I were the type of cat who wore a hat, I'd take it off to you. I'd even suggest that Ms. Rappe give you a little shout out at the bottom of her article so that more of us Watchmen fans might have a chance to take a look at your page... But I'm just some random movie fan, so I doubt my suggestions hold much sway around here....
Although there was that one time she changed the font on her Geek Daily banner, at my request. So who knows.

Wow -- VERY detailed work, Rodney. My e-mail has been on the fritz all day, so I didn't get it soon enough to add to the post.
But I am sure this isn't the last we've heard from the court, so I will toss you a link next time. I bet there's a lot of readers who would appreciate the work you put in.

I see why there was no summary judgment because the legal issues seem to be a mess. I worry that the 3/6 date will be missed ... and this is by far my most anticipated film next year, although I don't consider myself a Watchman fanatic.
I must say that I find Fox's behavior extremely annoying considering that Warner Brothers hardly concealed the fact that they were making the film (Zack Snyder discussed it in July 2007 at Comic-Con), yet they waited until 2/8/08 to file, just days before principle photography was complete (I found an article announcing that dated 2/22/08). Fox wanted leverage badly and this is it (I hear it might be Batman-related rights). Whatever. Whatever Fox is thinking about, it isn't the customer.
